By accessing or using ExitLink (exitlink.app), you agree to be bound by these Terms of Service. If you do not agree, do not use the platform.

2. Description of Service

ExitLink is a SaaS platform that enables users to create professional business acquisition listings, generate AI-enhanced marketing materials, manage NDA workflows, and communicate with prospective buyers. ExitLink is a marketing and presentation tool only — it is not a business brokerage, financial adviser, legal adviser, or marketplace.

3. Financial Information Disclaimer

All financial figures displayed on listings are provided by sellers and have not been independently verified by ExitLink. ExitLink makes no representations or warranties regarding the accuracy, completeness, or reliability of any financial information displayed on the platform. Buyers must conduct their own independent due diligence before making any investment or acquisition decision. ExitLink accepts no liability for losses arising from reliance on unverified seller-provided financial data.

4. AI-Generated Content Disclaimer

All AI-generated content — including Information Memorandums, NDA documents, listing descriptions, and valuation summaries — is produced for informational and marketing purposes only. This content does not constitute legal, financial, accounting, or investment advice. AI-generated NDA documents are templates only and have not been reviewed by a qualified solicitor. ExitLink strongly recommends that all parties seek independent legal advice before relying on any AI-generated document in a commercial transaction. ExitLink accepts no liability for any loss arising from the use of AI-generated content.

5. User Obligations

You agree to:

• Provide accurate and truthful information in your listings
• Not use the platform for fraudulent or misleading purposes
• Not post false financial data or fabricated business information
• Comply with all applicable laws, including Australian Consumer Law
• Not attempt to circumvent NDA gating or access restricted documents without authorisation

6. Subscription and Payment

Access to listing creation features requires a paid subscription at the rates published on our pricing page. Subscriptions are billed monthly via Stripe. You may cancel at any time. No refunds are provided for unused portions of a billing period. ExitLink reserves the right to modify pricing with 30 days' notice.

7. Intellectual Property

You retain ownership of all business data you upload. By using ExitLink, you grant ExitLink a limited licence to process and display your data to deliver the service. AI-generated content produced using your data is owned by you. ExitLink retains ownership of its platform, software, and design.

8. Termination

ExitLink reserves the right to suspend or terminate accounts that violate these Terms, post fraudulent listings, or engage in abusive behaviour, without notice and without refund.

9. Limitation of Liability

To the maximum extent permitted by law, ExitLink's liability for any claim arising out of use of the platform is limited to the subscription fees paid in the 3 months preceding the claim. ExitLink is not liable for indirect, consequential, or special damages of any kind.

10. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Victoria.
